The Residence Programme, launched in 2014, aims at attracting EU/EEA/Swiss nationals who are not permanent residents in Malta to take up residency in Malta by also offering successful applicants a special tax status.

The Programme allows visa-free travel within the Schengen Area.
- 2. Right of Residence
Successful applicants enjoy an indefinite right to reside and stay in Malta provided that the eligibility criteria are constantly satisfied. The applicant and his dependents are also able to work, study and conduct business in Malta.
- Tax Benefits
- Flat tax rate of 15% applicable to income arising outside Malta which is remitted to Malta.
- No Malta Tax is charged on income sourced outside of Malta and not remitted to Malta.
- No Malta Tax is charged on capital gains income sourced outside Malta.
- Income and Capital Gains sourced in Malta will be subject to tax at the rate of 35%.
Beneficiaries under this programme are however subject to a minimum of €15,000 tax payable which covers tax payable by the beneficiary and the dependants. Malta boasts over 60 Double taxation treaties, some of which are with non-EU countries such as Canada, Australia and the USA, ensuring that the same income is never taxed by both local and foreign authorities. Beneficiaries under this programme are therefore also able to avail themselves of such double-tax treaties.
- EU/EEA/Swiss national.
- The individual does not benefit from any other Tax Residency programme in Malta.
- The applicant must own or rent a qualifying property which the individual considers as his primary place of accommodation.
- The applicant must be economically self-sufficient to sustain himself and his dependents.
- Once the applicant’s tax status is confirmed, the applicant must not spend more than 183 days in a year in any other country. A declaration to this effect is to be provided annually.
- The applicant and the dependents must be covered by a comprehensive EU health insurance.
- The applicant must be a fit and proper person.
The applicant must undertake to either:
- Acquire a property valued at a minimum of €275,000, reduced to €220,000 if the property is located in the southern regions of Malta or in Gozo;
- Rent a property for a minimum annual rent of €9,600, reduced to €8,750 if the property is located in the southern regions of Malta or in Gozo.
- Spouse or person with whom the beneficiary is in a stable and durable relationship.
- Minor children and any minor children who are in the care or custody of the person in point (a).
- Children under the age of 25 of either the applicant or the person mentioned in point (a), provided that they are not economically active.
- Children (irrespective of age) who are unable to maintain themselves due to a circumstance of illness or disability of serious gravity.
- Any financially dependent direct relatives.
- Domestic staff including a “Special Carer” being an individual that has been appointed for substantial and curative care and has been in service for a minimum period of two years.
- Birth certificates.
- Marriage certificates (if applicable).
- Police Conduct.
- Bank reference letters.
- Any other documents as may be requested.
An administrative fee of €6,000 is payable upon application.
An applicant wishing to benefit under this programme must be represented by an ARM (Authorised registered mandatary). The estimated timeline for this application process is typically around 4 months.
